 Terms and Conditions

 ALL BIDDERS HEREBY CERTIFY THAT THEY HAVE READ AND FULLY UNDERSTAND THE TERMS AND CONDITIONS AND THEY AGREE TO BE BOUND THEREBY. Each auction may have additional terms not listed here. It is the buyer’s responsibility to understand all the terms and conditions prior to submitting a bid.

 

Horizon Auctions Role in Auction

Horizon Auctions, Inc. is acting as agent of the seller in an online auction and is not responsible for acts omissions or representation of the seller or any of the seller’s principals, officers, directors, employees or other agents.

 

REGISTERED MAIL

All Bidders must register and be in good standing with Horizon Auctions, Inc. in order to bid on items listed on unreserved online auctions and on equipment listed for sale. Horizon Auctions, Inc. reserves the right to remove a bidder for not complying with the terms and conditions.

 

Equipment sells “AS IS, WHERE IS”

All property sells” as is, where is” with no warranty or guaranteed express or implied. Inspection of the property before bidding is strongly encouraged. Written or verbal descriptions from the seller, seller’s agent or Horizon Auctions, Inc. are not guaranteed. Bidder’s are responsible for inspection of the items and will not be issued a rebate or refund for any reason. Seller’s contact information and location of the item will be provided with the listing description of each item for sale.

 

Buyer’s Premium

Horizon Auctions, Inc. has a buyer’s premium of 10 percent (10%) If there is not a buyer’s premium it will be listed in the terms of the specific auction. For example, it the successful bid is $100.00, Buyer will be invoiced for $110.00, The buyer’s premium is not negotiable and is payable by all Buyers.

 

Deposit

A Cash Deposit may be required to register if stated or may be required to continue bidding after a monetary threshold has been reached. Failure to make a required deposit may result in suspension of bidding privileges.

 

Contract and Payment

By placing a bid on an item, the bidder represents, warrants and undertakes that it has the authority and capacity to enter such bid and close the transaction and that any bid that it makes constitutes an irrevocable offer to buy the item in question for the full amount of the bid, plus the buyer’s premium and any applicable taxes. A legally binding contract between a bidder, on the one hand, and Horizon Auctions, Inc., and seller, on the other hand, is formed when a bidder makes the highest bid and the online auction is closed. All sales are final’ a bidder bay not cancel a bid after the auction closes. When the auction closes, the highest bidder (referred to herein as “Buyer”) shall pay for the item purchased by the date and time identified for removal on the specific auction site. If Horizon Auctions, Inc. determines that the highest bid was not a bona fide bid, the item will not automatically go to the second highest bidder. If Buyer does not pay for and remove an item within the applicable removal period, Horizon Auctions, Inc. may resell the item without notice. If an item is resold for an amount less that the original, highest successful bid, Buyer is obligated to pay the difference. If full payment is not made by the end of the applicable removal period, Buyer’s bidding privileges as to any other Horizon Auctions, Inc. auctions may be suspended. Buyer’s bidding privileges might not be reinstated until Horizon Auctions, Inc.’s invoice has been paid in full, regardless of whether an item has been resold.

 

When Paying by Check

You authorize checks returned unpaid to be represented electronically, and a fee equal to the maximum state allowed recovery fee may be recovered electronically or by draft. Returns not recovered may be subject to attorney fees and or other fees with applicable.

 

Titles

Titles will be filled out in the name of the purchaser unless otherwise directed. ALL titles will be endorsed – no open titles will be issued. There will be a $35.00 title transfer fee for each title. Title will be mailed to the buyer by certified mail 14 days after payment in received. Some vehicles are sold with no title.

 

Removal

Online auctions end on a Tuesday and removal of items must be accomplished by the first Friday following the end of the Auction. Successful bidders are responsible for loading and removal of any and all property awarded. Small carryout items must be removed within the first 24 hours from the end of the sale. Buyer shall be solely responsible for the removal and/or shipping of all items and all costs related thereto. Horizon Auctions, Inc. assumes no responsibility for small items left after that time. No lot can be removed during the sale. All removal shall be at the expense, liability and risk of the purchaser, including disconnecting of utilities. If the purchaser does not remove an item within the announced check-out period, Horizon Auctions, Inc. and the seller may, at their sole discretion, deem the item to have been abandoned by the purchaser and the purchaser will have no further rights with respect to the item. Notwithstanding the foregoing, Horizon Auctions, Inc. and the seller reserve the right to change the purchaser for the costs of storage beyond the checkout period, and/or such said items may be resold at public or private sale, without notice, with all deficiencies and expenses charged to the defaulting purchaser.

 

Record

The record kept by Horizon Auctions, Inc. will be taken as final in the event of any dispute.

 

Indemnification

Buyer indemnifies and holds harmless Horizon Auctions, Inc., its directors, officers, employees and agents against any damage or loss which Buyer, Horizon Auctions, Inc. or third-parties may suffer or incur with respect to loss, damage or injury arising from the removal of an item.

 

Choice of Law and Venue

All disputes relating to a Horizon Auctions, Inc. online auction and the terms and conditions herein shall be governed by and interpreted in accordance with the laws of the State of Washington. All claims relating to a Horizon Auctions, Inc. online auction and the terms and conditions herein shall be brought in “District Court in Kitsap County, Washington, and bidders hereby consent to the jurisdiction of said Court.
